We process personal data only to the extent necessary to provide a functional website, respond to enquiries, take steps prior to entering into a contract or perform a contract.

Depending on the purpose of processing, the processing is based in particular on:

Article 6(1)(f) GDPR, where the processing is necessary for the purposes of our legitimate interests and such interests are not overridden by the interests or fundamental rights and freedoms of the data subject;
Article 6(1)(a) GDPR, where express consent has been given.

Where processing is based on consent, that consent may be withdrawn at any time with effect for the future. The lawfulness of processing carried out before the withdrawal remains unaffected.

3. Hosting and Website Provision by Wix

Processing Outside the European Economic Area

Wix.com Ltd. is based in Israel. The European Commission has adopted an adequacy decision in respect of Israel.

Wix also uses affiliated companies and subprocessors in other countries. Processing may therefore also take place outside the European Union and the European Economic Area.

According to Wix, transfers to countries for which no adequacy decision exists are based on appropriate safeguards pursuant to Article 46 GDPR, in particular the Standard Contractual Clauses adopted by the European Commission. Wix may also implement additional technical, contractual and organisational safeguards.

We have only limited influence over the specific technical processing locations within Wix’s infrastructure.

4. Server Logs

Whenever the website is accessed, technical log data or server log files may be generated automatically.

This data is required in particular to:

deliver the website technically;
identify and remedy errors;
ensure the stability and security of the system;
identify misuse, unauthorised access and attacks;
protect the technical infrastructure.

We do not combine this technical data with other data sources for the purpose of creating personal user profiles.

Log data is retained only for as long as necessary for the technical and security-related purposes described above. It may be retained for a longer period where there are specific indications of a security incident or where statutory obligations require such retention.

We have only limited influence over the retention periods determined by Wix for individual technical log data.

Technical operational, security and functionality data processed by Wix for the provision of its platform remains unaffected.

6. Contact Form

A contact form may be provided on our website. When a person uses the contact form, we process the information entered by that person.

Depending on the structure of the form, the data processed may include:

name;
company;
email address;
telephone number, where provided;
subject;
content of the message;
information concerning the requested project;
time of transmission;
technically necessary security and connection data.

Mandatory fields are required so that we can identify and respond to the enquiry. Voluntary information is treated as such.

The data submitted through the contact form is processed through Wix Forms and may be stored in the Wix dashboard, the form-submission overview, Wix Contacts or Wix Inbox.

The processing is carried out:

on the basis of Article 6(1)(b) GDPR, where the enquiry relates to a quotation, a potential engagement, an existing contractual relationship or other pre-contractual measures;
on the basis of Article 6(1)(f) GDPR in the case of other business-related or general enquiries.

Our legitimate interest consists in processing and responding to incoming enquiries and documenting business communications.

The data is deleted once the enquiry has been fully dealt with and no statutory retention obligations, contractual requirements or legitimate grounds for further storage apply.

Where a contract is entered into, the data may be stored for the duration of the contractual relationship and thereafter in accordance with statutory commercial and tax-law retention obligations.

7. Contact by Email or Telephone

If you contact us by email or telephone, we process the personal data you provide in order to handle your enquiry.

This may include, in particular:

name;
company;
email address;
telephone number;
communication content;
transmitted files;
date and time of the communication.

The processing is based on Article 6(1)(b) GDPR where the communication serves the initiation, preparation or performance of a contract.

For other enquiries, the processing is based on Article 6(1)(f) GDPR. Our legitimate interest consists in the proper handling of business communications.

When emails are sent, data is additionally processed by the email service provider used by us. Information concerning this service provider must be added where it processes personal data outside the European Economic Area or where specific data-protection information is required.

8. No Newsletter and No Direct Advertising Through the Website

We currently do not offer an email newsletter.

Contact details submitted through the contact form or as part of an enquiry are not used for newsletters, automated advertising emails or comparable marketing activities without a separate legal basis.

If a newsletter is introduced in the future, this Privacy Policy will be updated accordingly. Any required consent will then be obtained separately.

9. No External Analytics or Advertising Services

We currently do not use any external analytics, profiling, retargeting or advertising services.

In particular, we do not conduct cross-website monitoring of user behaviour or create personalised interest or advertising profiles.

We store personal data only for as long as necessary for the respective processing purpose.

Matters That Must Be Clarified Before Publication

1. Controller

The Privacy Policy must not identify only “Unshootable.” In the case of a sole proprietorship, the proprietor’s full name and a valid service address must also be stated.

2. Email Provider

It is currently unclear whether the email service used is, for example, Google Workspace, Wix Business Email, Microsoft, IONOS or another provider.

A separate data-protection provision and information concerning transfers to third countries may therefore be required.

3. Website Scan and Cookie Banner

Wix states that, without an activated cookie banner, all cookies and scripts may be loaded when the website is first accessed.

Where the banner is activated, only essential cookies and scripts should initially be loaded. The Wix or Usercentrics cookie banner should therefore be activated, and the published website should be tested in incognito mode.

4. External Content

The Privacy Policy must be updated as soon as services such as the following are added:

YouTube;
Vimeo;
Google Maps;
Instagram;
Calendly;
WhatsApp;
Google Fonts loaded from external servers;
other embedded third-party tools.

Embedded YouTube and Google Maps content, in particular, may transmit visitor data to Google.

5. Contact Form

A mandatory consent checkbox is generally not required merely for the use of a contact form.

The processing of a specific customer enquiry may generally be based on pre-contractual measures or the legitimate interest in responding to the enquiry.

However, a clearly visible link to the Privacy Policy should be displayed near the submit button.

Article 13 GDPR requires information to be provided in particular concerning:

6. Relationship with Wix

Under its current data-processing agreement, Wix generally treats the website operator as the controller and Wix as the processor.

Wix identifies Israel as its initial processing location on the basis of an adequacy decision. For transfers to other third countries without an adequacy decision, Wix refers in particular to the Standard Contractual Clauses.

7. Legal Uncertainty

Without a technical review of the published website and without precise knowledge of the email provider and all embedded services, it cannot be determined with certainty whether this version fully describes all processing activities actually taking place.
